Terms of Service
These terms govern your use of Missenger's AI receptionist service. By signing up, you agree to these terms. If you have questions, contact us before subscribing.

1. The Service
Missenger provides a done-for-you AI receptionist service for small and medium businesses in Ontario, Canada. We provision a custom AI voice agent that answers calls on your behalf, captures information, books appointments, and dispatches emergencies according to instructions you provide during onboarding.
The service includes: AI voice agent configuration, phone number provisioning, call handling, transcription, summary delivery, and ongoing prompt tuning. Specific features depend on your selected plan.
2. Eligibility
You must be at least 18 years old and authorized to enter into contracts on behalf of the business you represent. Missenger is currently available only to businesses operating in Ontario, Canada.
3. Pricing and Billing
- Setup fee: $1,000 CAD, charged once when you subscribe.
- Monthly fee: $497 CAD for the Solo plan or $697 CAD for the Team plan, billed automatically via Stripe on the same date each month.
- Overage: $0.55 per minute for calls exceeding your plan's included minutes.
- Cancellation: You may cancel anytime. Your service continues until the end of your current billing period. No partial-month refunds except as covered by our money-back guarantee.
We may adjust pricing with 60 days' written notice. Existing customers keep their current rate for the duration of their continuous subscription.
4. Money-Back Guarantee
If you are not satisfied with Missenger within the first 14 days of your paid subscription, contact us for a full refund of your setup fee and first month's service. After 14 days, the monthly subscription is non-refundable but can be cancelled anytime.
5. Acceptable Use
You agree not to use Missenger for:
- Illegal activities or fraud of any kind.
- Harassment, threats, or abuse directed at callers or our staff.
- Deceptive practices (e.g., pretending to be a human without disclosure when legally required).
- Activities that violate Canada's Anti-Spam Legislation (CASL).
We reserve the right to suspend or terminate service immediately for violations of this section.
6. AI Disclosure and Call Handling
Missenger's AI agents disclose that they are an AI receptionist when asked by callers, in compliance with Canadian consumer protection standards. You are responsible for ensuring your use of Missenger complies with any industry-specific regulations that apply to your business.
While we strive for high accuracy, AI systems can make errors. You are responsible for reviewing call summaries and transcripts for accuracy, especially for urgent or high-stakes calls.
7. Data and Intellectual Property
You retain ownership of your business name, branding, and customer relationships. We retain ownership of the AI technology, prompts, and infrastructure we build to deliver the service.
Call transcripts and recordings are your data. We provide them to you through your dashboard and email summaries. You grant us a limited license to process this data solely for the purpose of providing and improving the service.
8. Limitation of Liability
Missenger is provided "as is" to the extent permitted by law. Our liability for any claim arising from these terms or your use of the service is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for: lost profits, lost business opportunities, or damages arising from missed calls where the root cause was outside our reasonable control (carrier outages, natural disasters, your failure to provide accurate on-call information).
9. Termination
Either party may terminate this agreement with 30 days' written notice. We may terminate immediately if you violate the acceptable use policy or fail to pay amounts due.
Upon termination, your AI receptionist will be deprovisioned and your phone number released. We will provide you with a final export of your call data upon request.
10. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Toronto, Ontario.
11. Changes to These Terms
We may update these terms from time to time. Material changes will be notified by email at least 30 days before taking effect. Continued use of the service after changes constitutes acceptance.
